Conditions of Tenancy

 

All holiday accommodation is let by Forster Tuncurry Property Management and is subject to the following conditions.

1.           All bookings commence after 1.00 p.m. on arrival date and terminate at 8.00 a.m. on departure 
               date.
2.            Unaccompanied children under the age of 12 years are NOT PERMITTED in lifts at any time.
3.            Overcrowding beyond the capacity of the described premises WILL NOT BE ALLOWED BY 
               THE HEALTH AUTHORITIES, OWNERS AND AGENT.
4.            All balances of rents due are to be paid to our office 3 days after your arrival.
5.            Tenants please check inventory upon arrival and advise Agent of any discrepancies.
6.            The premises must AT ALL TIMES be kept clean and the accommodation must be left in a 
               clean and tidy condition.  The agent has the right to inspect the premises at any time.
7.            Tenants agree to allow Agent or his nominee to enter accommodation to arrange any necessary 
               repairs.
8.            All breakage's and damage must be paid for.
9.            Fish must not be cleaned on the premises, or oysters be opened.
10.          Garbage must be wrapped and placed in receptacles provided.
11.          DOGS OR OTHER PETS ARE NOT ALLOWED IN ANY OF OUR HOLIDAY LETTINGS.
12.          Tenants are responsible for the safekeeping of accommodation keys.  Only one set of keys will 
               be handed out for each letting.  Tenants requiring a key from the agent or his representative
               after office hours will be charged a service fee of $20.  Tenants are liable for damage caused 
               when doors have to be forced open or a locksmith called owing to keys being lost.
13.          IT IS A BREACH OF THE STRATA TITLE ACT, 1973 TO HANG CLOTHES AND TOWELS
               AND OTHER ARTICLES OVER OR ON BALCONIES.  TENANTS ARE REQUESTED TO HANG
               CLOTHES ON THE FOLDING CLOTHES AIRER PROVIDED.
14.          Failure to comply with any of the conditions of tenancy will result in termination of the tenancy 
               within 24 hours of verbal notice by the letting agent and/or forfeiting any security deposit paid.
15.          CANCELLATION:  Part cancellation of a booking will not be accepted.  All cancellations must
               be confirmed in writing.   Deposits on cancelled bookings are only refundable, less a 
               cancellation fee of 13.75% of one weeks’ rent once the accommodation has been relet for the     
               full term of the cancellation and confirmed by a deposit.
16.          Rebookings must be confirmed with one weeks rent as deposit within the first 3 days of present 
               occupancy and are arranged only where tenancy has been satisfactory to Agent's requirements.
17.          IMPORTANT - PLEASE NOTE - Rents are subject to increase without notice, especially in the
               case of the unit being upgraded or renovated and on the instructions of the owner.  Each
               tenant will be given the opportunity of paying the increase or a full return of deposit at their 
               request.
18.         On payment of the deposit thereof the tenant authorises and directs the agent to release the 
               monies paid as deposit to the owner.
19.          The booking is made in good faith by us but may be subject to change as may be notified by the
               owner prior to the commencement of the booking.  We cannot accept responsibility for actions 
               taken by the owner of the premises outside our control.  Every reasonable endeavour will be 
               made to offer alternative accommodation should this occur.
20.          In the event of the property being offered for sale, the tenant agrees to allow the owner or his
               agent to inspect the property with prospective purchasers during reasonable hours by 
               appointment.
21.          Please note at time of publication all advertised inclusions in our properties are up to date.  We 
               are not responsible for any changes, which occur thereafter.  We are not responsible for any 
               unforeseen breakdowns of appliances etc.  No discount will be negotiated for any of the above.
22.          In the event of renovation/building work being carried out in or near the premises, such work is
               beyond our control and we cannot accept responsibility for any disturbance, noise or 
               inconvenience you may suffer as a result.  No discount will be negotiated for any of the above.
23.          In the event of any service being withdrawn from the premises by the Strata Managing Agent 
               such withdrawal is beyond our control and we cannot accept responsibility for their action or
               any inconvenience you may suffer as a result.  No discount will be negotiated for any of the
               above.
24.          Should a security deposit be payable on your rental the deposit will be held in our Trust 
               Account until your vacating date.  Once the property has been inspected the security deposit 
               will then be refunded to you by way of refund to your credit card or direct credit to your bank
               account when deposit is paid by cash or cheque, usually the next working day, however, this may 
               take longer during busy holiday periods.  For those tenants paying by cash or cheque they must 
               advise their account details to our office prior to vacatingt he property.  REFUND CHEQUES 
               WILL NO LONGER BE AVAILABLE FOR RETURN OF SECURITY DEPOSIT.          
25.          PLEASE NOTE THAT THE PREMISES ARE FULLY EQUIPPED WITH THE EXCEPTION OF 
               LINEN AND PERSONAL REQUISITES.
